Lindsay Lohan to Serve Only Fraction of Jail Sentence

BEVERLY HILLS -- A judge sentenced Lindsay Lohan to 90 days in jail Tuesday for violating her probation in a 2007 drunk driving case.

In making her ruling Judge Marsha N. Revel cited several instances over the last few years in which the starlet lied about taking drugs and drinking.

"It's like someone who cheats but doesn't think it's cheating if they don't get caught," Revel said.

Before sentencing, a tearful Lohan addressed the court, saying "as far as I knew I was in compliance with my programs."

"I wasn't trying to get special treatment," the actress said.

"I have to provide for myself. I have to work. Having said that, I did everything to balance my jobs and showing up. I'm not taking this as a joke. It's my life. It's my career...I take responsibility for my actions. I've tried to do the best I can. It's been such a long haul, I don't want you to think that I don't respect you."

Lohan will likely only serve only a fraction of her jail day sentence.

Los Angeles County Sheriff's spokesman Steve Whitmore said women sent to jail for nonviolent crimes generally serve 25% or less of their sentence due to overcrowding.

In 2007, Paris Hilton generated headlines when she was released from custody after less than four full days in jail, despite a promise that she would serve 23 days of a 45-day sentence.

Lohan will serve her time in Century Regional Detention Facility in Lynwood.

In addition to the jail time, Revel also sentenced Lohan to 90 days in-patient rehab.

She is to surrender and begin her jail sentence July 20. Rehab will follow.

The sentence was handed down at the conclusion of a probation revocation hearing set for the "Mean Girls" star after she missed a court date in May. Lohan was promoting a film project at the time at the Cannes Film Festival and claimed her passport was stolen.

She has been required to wear an ankle alcohol monitor since then.

Weeks later, the monitor issued an alert after Lohan attended the MTV Movie Awards and after-parties.

Prosecutor Danette Meyers had argued that Lohan violated probation by drinking after the awards show, and suggested the actress' SCRAM bracelet was tampered with. Meyers said she had evidence that Lohan was drinking that night.

The actress claimed someone spilled a drink on her leg.

Under the terms of her probation, Lohan was ordered not to drink any alcohol.

Lohan's attorney Shawn Chapman Holley argued that she hadn't prepared to defend against the alcohol monitor report because of what Revel told her previously in a closed session.

The judge had apparently told Chapman Holley that information from the monitor would only affect bail for the actress, not probation.

Revel doubled Lohan's bail to $200,000 after receiving the alert.

Revel ruled on Tuesday that she would not allow the prosecutor to present evidence related to the SCRAM bracelet.

The hearing was to remain exclusively about whether Lohan, 24, violated probation by not attending enough alcohol education classes at the time of her last hearing.

The actress has been on probation since August 2007 after pleading guilty to misdemeanor drug charges and no contest to three driving charges.

Lohan spent 84 minutes in jail following the plea.

She had to ask for a yearlong extension in October after she failed to complete her court-ordered alcohol-education courses on time.
